“Inspire Your Friends” Program
You do not have to be registered for this event to inspire others and qualify for any drawings. Being registered for the event will not increase your chances of winning. BACK TO PROGRAM
1. CAN I PARTICIPATE?
Except as provided in paragraph 6 below, this Program is open to legal residents of the fifty (50) United States and the District of Columbia who:
(a) Visited the runsurfcity.com site and read about the Program; and/or
(b) Have opted in for Surf City USA Marathon emails; and/or
(d) Have participated in a previous Surf City USA Marathon event; and
(e) 18 years or older as of October 1st, 2008.
2. ELIGIBILITY
This promotion begins at 12:01 am PST on September 28, 2008 and ends at 9:00 p.m. PST December 7th, 2008. There is no entry form. Persons recognized for participation are identified exclusively by the “friends” they have inspired to register for either the full or half marathon (not the 5K) during the online registration process. In order to qualify as a participant in the Inspire Your Friend promotion, the “friend” must enter your name and city as prompted in the online registration process. This is the only way to qualify to get on Inspiration Leaderboard for reward verification. All “friends” must be officially registered for the 2009 Surf City USA® Marathon or Half Marathon by 9:00 p.m. PST on the deadline dates indicated above for each drawing. “Friends” who register for the 5K will not count toward the total “friend” recruitment number. Misdirected, lost, late, inaccurate, incomplete, or illegible entries are not the responsibility of Sponsor, and are void. False or deceptive entries or acts will render the entrant ineligible. Participants who disregard these Official Rules may be declared ineligible.
3. WHAT CAN I WIN?

Motor Scooter (1 available) ARV $1100
No substitution or transfer of reward or cash redemption is permitted, but Sponsor may at its option substitute cash value or another reward it believes is of equal or greater value. Taxes, if any, are the responsibility of each winner.
4. HOW DO I WIN?
Each potential reward winner will be determined by the number of friends they recruit to register for the 2009 Surf City USA® Marathon or Half Marathon AND which are indicated by the “friends” entering YOUR NAME and CITY during the online registration process. No claims made by individuals which are not substantiated by corresponding “friends” who correctly followed the Inspired By A Friend instructions in the online registration process will be honored. Final numbers will be determined on or about December 8th, 2008. The number of eligible friends recruited will determine odds of winning each reward.
5. HOW DO I FIND OUT IF I WON?
Each potential reward winner will be notified via email within approximately 14 days from the date of the end of the Contest. Any potential reward winner who declines to accept the reward, has violated any of these Official Rules, does not respond to the award notification by the date listed on the notification, or is found to be ineligible will be disqualified and an alternative potential reward winner shall be chosen. Each potential reward winner (or a potential winner’s parent or legal guardian if the potential reward winner is a minor in the jurisdiction in which they reside) will be required to sign and return a Declaration and Release within 1 day of notice or they will be disqualified and an alternative reward winner shall be chosen. Each potential winner’s guests may also be required to sign a Declaration and Release. If a minor wins the reward, the reward will be awarded in the name of the minor’s parent or legal guardian who executes all required paperwork on the minor’s behalf. Each winner (or parent or legal guardian on behalf of the minor and him/herself) releases Sponsor, their affiliated companies and all employees, agents, and representatives from all liability and responsibility of any kind which is related in any way to the reward (including without limitation any property loss, damage, personal injury or death) and consent to the use of their names and likenesses for advertising and promotional purposes without additional compensation, except where prohibited by law.
6. WHO CAN’T PARTICIPATE?
Persons under the age of 18, employees, their immediate families, and persons living in the same household as employees of Sponsor, their affiliated companies and all associated advertising and promotion agencies of each and suppliers of the rewards for this promotion are not eligible to win.
7. GENERAL CONDITIONS.
Void where prohibited. This Contest is subject to all applicable Federal, State and local laws and regulations. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the reward at random from among the eligible entries received up to the time of the impairment. Sponsor is not responsible for any printing errors in these Official Rules or other materials related to this Contest. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Sponsor is not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Contest; inability to access any web site, theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or on any web site or printing or other errors. Proof of entering entry information at the web site is not considered proof of delivery or receipt. Illegible and incomplete entries will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. False and/or deceptive entries or acts shall render entrants ineligible. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder.
8. HOW DO I OBTAIN A WINNERS LIST?
To receive a list of reward winners, send a self-addressed, stamped envelope after December 30th, 2008 to: Kinane Events, 800 Grand Ave. C-10, Carlsbad, CA 92008. All winners’ list requests must be received by December 31st, 2008.
9. HOW DO I GET MY REWARD
Most rewards will available to be picked up at the Surf City USA® Marathon expo between January 30th – February 1st, 2009. The motor scooter may be picked up at the dealer, or will be shipped to the recipient free of charge. Any rewards not picked up at the expo will be forfeited.
9. HOW WILL DISPUTES BE HANDLED?
Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any rewards awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
10. WHO IS THE SPONSOR OF THIS PROMOTION?
This promotion is sponsored by Pacific Shoreline Marathon, LLC. Sponsor reserves the right to modify or cancel this promotion at any time and, in the event of cancellation, substitute another in its place.
